Non-dlsclosure question

Hypothetical situation:

Someone is arrested for injury to a child. The case gets indicted and later the prosecution offers a plea arrangement of assault. The defendant agrees to the plea arrangement gets one year deferred adjudication. The defendant fulfills the conditions of the deferred adjudication and the case is subsequently dismissed. Would the defendant be eligible for non-disclosure and or expunction after the alloted time frame has passed?

It depends on what the defendant pleads to. You can't non-disclose an injury to a child case. You also can't non-disclose an assault if it alleges family violence. However, if regular assault then can non-disclosed after 5 years from date of discharge and dismissal (i.e. when deferred is completed).
