Legal Question in Criminal Law in Texas
If its my first offense never had criminal background and have used to be in military can I not go to jail for theft over 1500

This really depends on the county that you are in. However for a first offense with no priors, it is likely that a plea bargain for probation or deferred adjudication can be negotiated. For this level of offense, if you are indigent, you should be appointed an attorney.
This is a very serious charge. You need a criminal defense attorney to help you.
