Legal Question in Criminal Law in Texas
If offered a plea bargain with 10 years confinement with 8 years probated. Does that mean that person has to go to prison for at least 2 years?

As presented, it is likely that the plea bargain is for 10 years in prison, but the sentence (the entire 10 years) is suspended and you would be placed on probation for a period of 8 years. Under Texas law, there isn't a split sentence where you serve 2 years and are on probation for the rest.
