Legal Question in Criminal Law in Texas
Can an officer siez my money just because
My g/f & I was driving through town & a police officer pulled us over because our licsens plate light was out and our car just happend to be full of all my mothers clothes because she just moved out of her house and she hadnt got them out of our car yet so the officer automaticly used that as an excuse to want to search our vehicle, during the search the officer finds a money bag in the back seat that contained jewelry bags, digital scales,& $1800.00 cash, the officer also dug through my g/f purse & found an inscence burner ( to some people also known as a pipe ) which had never been used for anything yet, we even had the inscence that went with it, the officer called it a crack pipe, which to me was an insult! so he took my g/f to jail & charged her with narcotics paraphanelia and they also seized the $1800 cause they said it was drug money! There wasnt any drugs involved in the whole ordeal, hell that became the first thing my g/f has ever been charged with her whole life! I dont think that just because the back seat was full of clothes should give the officer propable cause to search our vehicle or does it? & did the officer legally seize our money? thank you for your time in reading this, even if you dont have an answer 4 me!

You can get your money back.
There is a process the police will have to go through in order to keep your money and since this is Athens, they most likely are going to try and keep your money because 99 percent of people don't fight these cases.
