if an officer stole $800 out of a prisoner's car; what crime/level did he commit?

Theft of $500 to $1500 is a Class A misdemeanor. However theft by a public servant is enhanced to the next highest category of offense if the property stole came into the officer's custody, possession or control by virtue of his status a a public servant. In this case the theft would be enhanced to a State Jail Felony. If he has two or more prior convictions the offense is enhanced another degree (3rd degree Felony)
