Legal Question in Criminal Law in Texas

Passport Requirements

In 2001, I was placed on 5 years deferred adjudication probation for felony posession of marijuana. I've since completed my probation and have been released from probation. Will my felony posession charge and probation history keep me from being able to get a passport and travel out of the country?

Re: Passport Requirements

The short answer is no it should not. The long answer is that you should have a certified copy of the dismissal of the charge. The application does not ask for this information, however, it is available to law enforcement. Generally speaking, customs does not care when you leave, but does when you return. If you are a USC by birth, there should be no issue. If you are an LPR or naturalized USC, then this prior history may cause you to be flagged, and your conduct while outside of the US scrutinized. You may also want to check with the countries you are travelling to, regarding their admission requirements.
