It is punishable on conviction by a fine not to exceed $2,000 and/or confinement in jail for a term up to 180 days. If the person has never before been convicted of a felony in Texas, any other state of a Federal Court, he/she can apply for probation which the sentencing body (Judge or Jury) can grant or reject. Of course, most cases end with a plea agreement between the defense and prosecution.
If facing such a charge, you should contact a Board Certified Criminal Law Specialist to guide you through your options and work to avoid, not only fines and incarceration, but a permanent criminal record.
