The penalty depends on several factors including, but not limited to:
-what class of offense the district attorney intends to seek, e.g., Class A, Felony...
-what are the facts of the case
-are there areas for negotiation with the district attorney on setting the punishment
-will the judge agree with the punishment
-above all else, if the person is found guilty or not.
