If a person is arrested and not "read their rights" can the charges be dismissed?

Most likely not. Police officers are not required to read someone their rights in order to charge them with a crime. Rights are only read to someone if the police want to question them while they are in custody. If the rights are not read in that situation, any statements should be suppressed.
