Can a person file a motion of 1244-a if they were already on parole for a previous conviction?

A "person" does not file a 12.44 (a) motion. Only the state can agree to punishment under 12.44(a) - no motion need be filed. (Your lawyer can discuss this with the prosecutor.) Parole is irrelevant as far as qualification.
