Legal Question in Criminal Law in Texas
A person gets a job as a private driver only to learn that he's transporting escorts to and from appointments. He neither makes or solicits the appointments. Is he doing anything illegal?
1 Answer from Attorneys
Yes, he could be charged with Prostitution. Texas' Law of Parties (Section 7.02 of the Penal Code) provides:
(a) A person is criminally responsible for an offense committed by the conduct of another if:
...
(2) acting with intent to promote or assist the commission of the offense, he solicits, encourages, directs, aids, or attempts to aid the other person to commit the offense ... .
The State would argue that once he became aware of the criminal nature of the acts the passengers were committing and continued his employment, he has "aided or attempted to aid" the actual sex workers and/or the pimp/madam in the commission of a criminal offense.
