Legal Question in Criminal Law in Texas
petition to expunge, meaning of JGSA (judgment set aside?)
In 1982, my husband received 2 years probation for theft over 200. We've been told he can have the record expunged and he received ( I believe from a county clerk ) a rough looking copy of a ''petition to expunge''. I haven't been able to find a down-loadable copy of this. Also when I paid for a copy of his record on-line, it did not include the name of the judge. I don't know where to look for any more information if this is needed. Thanks for your help.

Re: petition to expunge, meaning of JGSA (judgment set aside?)
Go to the County or District Clerk's Office in the County where he received the probation. That clerk's office will have the Judgment and Sentence which will give you the information you need. Under Texas law he may not be able to have his criminal history expunged, but under a new law that went into effect back in September he may request to have them sealed. You should consult with a criminal defense attorney in your area, before proceeding further.
