Phone Harassment
My 14 yr old daughter has received 7 voicemails on her cellphone from 2 boys that attend school with her. In these calls the boys are saying very nasty vulgar things about her. The language is horrible. 5 different times they made reference to killing her and swore if they knew they could get away with murder they would do it. We made copies of the recordings and filed a report with our local sheriffs dept. It was labled as a terroristic threat but due to the fact that it was not an iniment or conditional threat charges can not be filed. Is it possible to file harrassment charges for the repeated phone calls, voicemails that were left & their content? The messages are all 3 mins long due to the fact that the boys continued to harass her until the recording shut off and then proceeded to call back over & over. We have alerted the school & the boys parents have been called. They have been instructed by school officials not to have any contact with her or have any of their friends to contact her but we feel there should be some sort of consequence to their actions. So, can we file harassment charges on them and can a restraining or protective order be issued since one of the boys lives in our neighborhood?

You can file harassment charges, if the police department will accept the charges. That is that decision, at this point. You can also sue them in civil court for damages (which you will have to prove), (which might get their attention, and could include an injunction against the boys).
