Legal Question in Criminal Law in Texas

Plea bargaining

My 37 year old brother is facing sex w/ a child (15 yr.old) charges. He had major surgery for oral cancer 6 months before he was arrested and has special needs because of the cancers aggressive nature (they had to remove numerous lynph nodes and all of his teeth). He has now lost his insurance. What medical assistance will be available for him if/when he is sentenced? Is the prison where he will be sentenced to be influenced by his medical/ needs or will he be more likely to be sent to a prison for sex offenders? The case could go either way at this point based on evidence,(of which I am not at liberty to discuss) he has only been charged not convicted. Because of the age of the victim her mother does not want this to go to trial. Does this mean it will be plea bargained? As part of the plea agreement can a particular prison be requested? He is being held for violation of probation for which he will go to trial for this Wed. I have been told that he will be eligible to be bonded out once it is determined his probation has been satisfied by time already served.

Re: Plea bargaining

I spent 15 years as a sex crimes prosecutor in Florida. What county is the case and who represents him? There are so many variables involved in fully answering your questions it would be impossible to adequately answer without knowing many more details. You may call me if you like.
