Legal Question in Criminal Law in Texas
pleas and criminal records
I have a question about taking a plea deal and pleading guilty to a lesser charge and what comes out on a criminal record. For example, if you are indicted for an aggravated assault charge and you have a very good defense attorney who gets you a deal to plead quilty to a misdemeanor simple assault charge. What shows on your criminal record at that point will the arrest, indictment for aggravated assault, and conviction for simple assault all show up or would just an arrest and conviction for simple assault show up? I would really like to know how this situation works. This is not my situation, because im sure that type of plea deal may be to far-fetched, but in actuality my situation is similar. How does this work? Thanks

Re: pleas and criminal records
Everything shows up on your criminal record.
Your criminal record will show what you were arrested for, the dispostion of that charge and what you were convicted of.
If you pled down and the other charge was dismissed you may be entitled to an expunction of the dismissed charge.
If you successfully completed deferred adjudication probation on the charge that was sentenced, you might be entitled to have the court enter an order of non-disclosure. However since you said that you were convicted, you probably would not entitled to the non-disclosure order.
See a criminal lawyer to advise you on the expunction issue.

Generally and based on what you have stated, you should seek the opinion of your defense attorney. You are paying that attorney for rendering legal services to your case. Your attorney will be able to provide you with the information that you are looking for.
