Legal Question in Criminal Law in Texas
Police misconduct
I was needing to know a few things. First of all is it illegal for a cop to tackle you just for talking crap to another person(not a cop). Second, after i was detained one of the arresting officers choked me to the point I almost lost conciousness, then pulled my hair. While all this was happening I was not resisting arrest. While in jail i was denied my phone call, I was trying to call out because I have a mental disorder and needed my medication. They said I couldn't have it because I was drunk, but they didn't give me a sobriety test or a breathalyzer or anything to determine that. While I was in the cell I continually hurt my self against the cell door to the point my head, fist and elbows were swollen and was not afforded any medical attention. This all happened because a fight had broken out that I was not even in. But the party that was involved in jumping the other party was handcuffed, then let go. It was 4 or 5 males over 30, that had jumped a 19 year old male and assaulted him with a beer bottle. He was knocked unconcious and later had to go to the hospital for stitches to his left eye.

Re: Police misconduct
If, through your attorney, you can establish all that you say with evidence, then the police will lose credibility in the trial. You do not say what you are charged with. You should expect that the police will probably have a significantly different version of the event. It sounds as if there was a chaotic situation, and in those cases, there are often varying versions of what happened. It is important to nail down witness testimony early on to avoid contamination.
