Legal Question in Criminal Law in Texas
police questioning of 16 y/o
today 1-21-08, the police called my 16 y/o son and asked him to come in to ''talk'' about something that happened in May '07 they never attempted to contact me can they question him without me present and if they do can it be used against him? this concerning an ''alleged'' sexual assault this is the 1st attempt at contact with my son for something that ''allegedly'' happened * mos ago. when this was pointed out to the officer calling his response was that he had been busy this whole thing seems odd to me what should we do?

Hire a lawyer for your son. The attorney can find out what the investigation is about, and learn if charges are going to be brought against your son. At 16 he is in the juvenile system (although if egregious, they can attempt to try him as an adult). A case that is 7 months old without action does not sound right, and will damage any attempted prosecution.
