Legal Question in Criminal Law in Texas
posession or not possession
If i have an apartment or house, and while i'm not in the apartment or house a person enters my property and smokes marijuana or even leaves an amount of marijuana there, am i responsible in any way for what that person has done on my property, even though i wasn't present at the time that the perpetrator was there, or when the police arrived.

Re: posession or not possession
If you truly did not know that marijuana was on your property is would be difficult for you to be found guilty.
One has to intentionally and knowingly possess marijuana in order to be convicted of possession.
If you don't meet the intentionally or knowingly elements you should not be held accountable.
You should however make arraignments keep people off your property that are bringing drugs in.
