Legal Question in Criminal Law in Texas

Possession

I got caught with 0.4 grams of crack/cocaine. I have a job and report to the bailsbondsman like I am suppose to. Would the judge give me jail time or just probation?

Re: Possession

It depends on many factors. First of all, it is automatic probation for this particular offense if you have no prior felony convictions. After that, I couldn't guess. It also depends on how the case proceeds. You could reach a plea agreement with the DA. You could plea Not Guilty and go to trial. If convicted, you could chose to be sentenced by the judge or jury. You could plea not guilty and try the entire case to the judge. It all depends. However, if you do not have an attorney, you should get one. Even if you just want to plea guilty, you should have a lawyer investigate the case for you. Sometimes there are legal issues that could possibly be raised. Sometimes law enforcement does not follow appropriate procedures and the case could be thrown out. A felony, which this case is, is very serious, and you should consult a lawyer before you do anything in court.
