Legal Question in Criminal Law in Texas
i have a possession of controlled substance under 1 gram in tx. the cop who arrested me also gave me a warning for license plate light. the address listed on warning is not where the stop occurred. does it have any bearing on my case?
1 Answer from Attorneys
No. As answered on the other site where you are also asking questions, the address on the warning ticket has little bearing on the possession case unless you can show that the officer is just completely wrong about all of the facts. He may not agree with your rendition of the facts of hwere the stop occurred. He may have listed the offense as where he observed it originally, not where the stop occurred. Does the fact that he recorded an address incorrectly mean that you did not possess a controlled substance? No. In traffic court you get cases dismissed for incorrect information such as addresses but not in criminal court.
