Legal Question in Criminal Law in Texas
Possession of a Controlled Substance
I received a possession charge back in 6/24/03. I plead guilty to the charge and received 2 years deferred adjudication probation. After serving 2/3 of the time, on 10/20/04 I was granted a dismissal and discharge of the indictment. I am having a hard time finding a quality career with the background checks. Can I have this expunged?

Re: Possession of a Controlled Substance
You are not going to get it expunged, however, you may be able to get an order of non-disclosure that shields it from the general public. If your charge was a felony, you have to wait 5 years; some misdemeanors are a 2 year wait, and some can be filed immediately. Contact a criminal defense attorney in that county for more guidance.
