possession of meth with intent to deliver

my brother-in-law was recently arrested for possession of meth with intent to deliver ( under 4, but less than 200 ) actual amount was 41.2 grams

he has a couple of other cases pending. probation violation ( minor in possession of alcohol) and evading arrest. im curious how much time is generally given for the meth charge. he has a small child that will need care while he is doing his time and we really need to know how long we can expect for him to be gone.

The answer depends totally upon what system he is charged in. If in the federal system, expect in the neighborhood of 5 years, no probation, no parole, 53 days/year good time. His prior record could raise the ante. There is a drug war on, and it is focused on meth right now, and meth defendants do time.

The answer could be more favorable in the state system.

Surely he has a lawyer who can answer these questions? Almost no one faces such charges without a PD or a CJA lawyer.
