Legal Question in Criminal Law in Texas
post dated check
I gave a post dated check to Advance Cash America for a loan. I was unable to pay the loan and they sent they check thru but it bounced. I know that in Texas ther penal code says that post dated checks are not prosecuted under the theft by check statute but they are sending me threatening letters saying they will prosecute. Is this legal?

It is improper to threaten criminal prosecution for a civil debt.
