Legal Question in Criminal Law in Texas
Re- posting trying for another shot...
How can a person get a 1st degree felon charge (Ten year sentence), when no one was killed? It was a drive by shooting and the boy was 17 years old at the time. He was only a passenger in the car and he did not shoot the gun. He had no prior convictions and now this young man is searing a 10 year sentence for organized criminal activity with a firearm. His court appointed attorney talked him into pleading guilty, after spending 7 months in county jail on 100,000 bond, that his attorney didnt get lowered. The same attorney defended the boy that shot the gun and he got 40 years. What I don't understand is that no one died and the shooter got 40 years??
This ad may look familer it was posted about 4 years ago and I was passed on this information and I am asking if there is anything I can do. Thanks.

The only way this case can be reopened now is if there is some form of actual innocence that would prove this young man did not commit a crime.
It would have to be evidence that was not available at the time or evidence that his court appointed attorney simply would not consider.
