If a Judge presiding over a criminal case rules against a defendant and that defendant is related to the Judge by marriage can there be a retrial or a mistrial?

It depends upon whether this information was known ahead of time, and a motion was filed to recuse the judge. It also depends upon whether the ruling reflected an abuse of discretion. There is a limited time to appeal the rulings, you have to act fast.
