Legal Question in Criminal Law in Texas
If someone had a previous Misdemeanor B deferred adjudication, completed it and the judge dismissed the charge, then they got a citation later for a Class C misdemeanor, can the dismissed case enhance the other charge ?

While the wording says "dismissed" after completion of a deferred, it is not truly dismissed and will remain on the record. However, it can NEVER be used for enhancement purposes.
