Legal Question in Criminal Law in Texas
Did they have probable cause?
To sum it up, my brother and his ex
got into a fight, and she is now trying
to press charges for him holding
''pornographic'' images of her. (she is
underage and he is not)
The police came to our house with a
warrant and seized items of his.
Apparently she mentioned my name
and they also took all my electronic
possessions, including my cell phone,
ipod, and my computer.
I literally have no connection to his
ex at all, and in fact, I know little to
nothing about their relationship.
When the police arrived at my house
I didn't even know they had broken
up. I've said a total of maybe 5 words
to her over the course of their
relationship or of me even knowing
her. (4 of the 5 were probably hi, the
5th being goodbye.)
I'm just trying to comprehend why
they took my stuff? Apparently she
mentions my name and that gives
them all the right they need to seize
all of my belongings?
They seized property of my brother
and they seized property of me, they
touched nothing else in the house.

What you need to look at to determine probable cause is the probable cause affidavit provided by the officer in order to get the search warrant.
