Legal Question in Criminal Law in Texas

probation and prior crimes

i have a friend who was doing pretty

darn well on probation for posession

of a controlled substance. she

recently flunked a drug test (after

about a year into her 18 month

probation period), though, and went

to jail. when in jail, they ran her

name through the system and found

out she had a warrant in another

county for theft. the thing is,

though, it is documented that she

committed the theft BEFORE starting

her probation. the amount of the

theft has been paid for and a bond

has been paid for the warrant. she is

still in jail for violation of probation.

(it's only been a few days now). will

they revoke her probation because of

the theft? she has an extremely

good relationship with her PO, who

understands how far she has come

and that she used to do really bad

things which she doesn't anymore.

Re: probation and prior crimes

Probation can be revoked for a crime only if the crime was committed after the person was put on probation. However, probation can be revoked for a dirty urine sample. The person should receive a copy of the motion to revoke probation which will show the allegations by the State for revoking the person's probation.
