Legal Question in Criminal Law in Texas

Probation and Prison

My brother was sentenced to 2 years in prison for 1 charge and at the same time was sentenced 2 years probation on another charge. If he is in prison, how will he report to his probation officer that is 150 miles away? We are being told that when he gets out, a warrant for his arrest will be issued because he did not report in to his probation officer. The probation officer said he was not notified that my brother was sent to prison for the other charges and will still be issuing the warrant. What will happen now and what can we do about this?

Re: Probation and Prison

1. Obtain a certified copy of the criminal Judgment and Sentence in the case for which your brother is serving time and send it by certified mail to the probation officer;

2. Include your brother's TDCJ prisoner ID number and his exact mailing address;

3. Have your brother write to his PO and tell him he will be in the system for the next 2 years but will be glad to check in by mail or phone at the PO's option;

4. Send a copy of everything to the judge who presided over the case in which your brother got probation.

5. Be sure to keep a copy of everything and a diary of your actions.
