Legal Question in Criminal Law in Texas
Probation Revocation due to unpaid fines,etc. Medical /Diabetes
I was placed on 2 yrs prob and have reported, did some community service and paid some on my fines. I was diagnosed with severe diabetes and hospitalized. The doctor wrote out orders for no work, nor driving or any physical activity until the diabetes was under control. I could not work and pay my fines but have reported monthly and have no new cases. Can they revoke my probation because I was medically unable to work and pay my fines? I cannot work until the doctor releases me. I need to know if because I have severe diabetes and doctors written orders not to work, drive, etc., can I be revoked? My probation ends next month so I will probably get a motion to revoke filed on me for not paying the probabtion fines and fees. You need to look at Chapter 42.12 of the Texas Code of Criminal Procedure, particularly at Section 19 of that Chapter.
