Legal Question in Criminal Law in Texas
Probation Revocation
My husband was on deferred adjudication for possession of a controlled substance (misdemeanor). Probation for one year. During that year, he was arrested for DWI that we are currently fighting since he was not driving, did not blow/give blood, won ALR hearing. However, they want to revoke his probation for the first offense (he completed everything he was supposed to during that year time frame-drug tests, classes, paid fees)pending the outcome of the 2nd offense. What are his chances of jail time since I am 7 months pregnant and he is the bread winner of the household?
