Probation revocation
Can ones probation be revoked if you havent been charged with the crime that is the alleged violation of probation?

Hello --
Technically, the level of proof for the revocation would be the same as for the conviction of the second offense. The reality is that a motion to revoke may be filed, but will not be ruled upon until the second offense is dealt with (i.e. dismissed, gone to jury trial, etc.) Hope this helps.
