Legal Question in Criminal Law in Texas

probation

I was sentenced in 2004 in the state of TX to 10 yrs probation. Ihave completed 50% of my sentencing. What are the steps I need to take now? Will I need an attorney?

If you have completed everything except passing the time on the remainder of your probation you may want to hire counsel to go to the Court to see if you can be released from probation earlier than ten (10) years. If you have had NO trouble with the probation officer your attorney should be able to convince him to go along with the request. If so you would be released and would never run the risk of revocation and having to serve part of the sentence.

You would need to file a motion for early termination of your probation. The judge will heavily rely on the opinion of your probation officer and the probation officer in the court, if you are in a jurisdiction that has a probation officer in the court. Talk to your probation officer first and figure out what their opinion is about you trying to early terminate your probation. If they are for it, then go ahead and file your motion for early termination.

You dont absolutely need an attorney, but it would be much easier with one.

Based on what you have written and dependent upon which jurisdiction your case was handled in, you may submit a motion to terminate your probation early to the Court. The judge will generally rely on the comments of the probation officer. You are not required to have a law firm represent you, but it is always wise to seek the advice of counsel.
