Legal Question in Criminal Law in Texas

Probation

My son is on probation in Texas for felony drug possession. He has finished all community service, paid all fees but was arrested for driving without a license (a mistake that is goind to be dismissed), thus violating his probation. He now has to do 8 weekends in jail driving from Austin to Ft. Worth, every weekend, has a 7-year old child and disabled wife. We are trying to relocate and transfer his probation to Florida, the judge said yes he could but probation officer said he must finish his weekends and stay in Texas for the remaining year of his probation or he is facing 2 to 5 years. Can we get an attorney and fight to have his probation transferred to Florida courts or doe the probation officer have the final word. Thanks in advance.

While judges trump probation officers, they listen to their recommendations. You need to get a lawyer and obtain a court order to transfer his probation to Florida or at the very least to the county where he resides so he wont have to drive from Austin to Ft. Worth.
