Probation violation

My boyfriend is on probation for possession of cocaine. He had a positve UA in March and then did not report for his April meeting with the probation officer.

The probation officer put out a warrant and he was arrested on Monday.

The arrest warrant shows that he has not paid his fines. The paper work from the trial shows the payments were to begin in April.

He went to a drug rehab program for 6 months and was released in November. He is on a deferred adjudication.

What are our options and possibilities for his release on bail and continuation of probation?

Bad news. Having received a deferred adjudication, upon "revocation" of his probation, your friend is eligible to receive the entire maximum sentence that he could have originally gotten.

Good news. If this is his first offense, the judge will probably return him to probation with stricter conditions.

Bad news. He is really only entitled to bail if the judge allows it.

Good news. If you have competent representation, you can probably turn this bad situation into a good result.
