Legal Question in Criminal Law in Texas
probation violation at end of probation period
I was convicted 10 years ago of larceny, pertaining to a charge of theft from a former employer. I was given 10 yrs probation and ordered to pay $30,000 in rest, court, and probation fees. After 4 yrs of being on probation I had some hot checks while I was in college (all misdem) served 5 mths in jail and 5 mths rest. center. I was released in 99 and have been reporting making payments and not having any problems. Upon advice from my probation office I worked out a settlement with the insurance co.(victim) in my case and after a nasty court hearing with the prosocuter the Judge agreed in my favor to accept the reduced restit. I paid the 6000.00 but the DA was mad and started digging for anything ,he did find that I had a yr period where I struggled with money and had some checks not clear the bank but I picked the checks up and paid everything no charges were ever filed, but 3 days before my probation ran out he filed a MTR on me. I had a court date about 2 weeks ago and everyone told me not to worry this was no big deal but it was. The Judge ordered a PSI and I have to go back in a few weeks for his decision. Can anything be done, should I seek new councel. I have worked very hard to not have anymore problems, the DA is after me

Re: probation violation at end of probation period
If you need to pay your lawyer additional money for additional time and effort invested in your case, you should do so today! Talk to your lawyer, ask him/her to consult with the investigator and the ADA. You need a STERLING PSI.
The attorney may have charged you a flat fee for work that did not include this additional charge. Obviously that attorney did well for you in the first hearing on restitution. Trust the attorney, but talk to the attorney. Make an appointment. Pay him/her for the service he is providing. It is well worth the investment.
Everyone that told you it was no big deal was wrong. This is a felony, and potentially jail time. The DA has a problem with laches, since the case was six to seven years old, but if not addressed properly, will have severe consequences for you.
