Legal Question in Criminal Law in Texas
What is the process for having misdemeanors on my record expunged? So I can get a job.
1 Answer from Attorneys
Were you convicted? Given deferred adjudication?
If there was a conviction, then the case cannot be expunged unless you get a pardon. If there was a deferred adjudication, you cannot obtain an expunction, but you can request a non-disclosure that will accomplish many of the same things.
If there was an arrest and you were found not guilty or the case was dismissed (under certain circumstances) you can have the arrest and case expunged.
We frequently get calls in our office about expunctions and the majority of times the person does not qualify. There are myths that you can expunge something after 10 years. There is no such law at this time.
Talk to an attorney to see if you might qualify for either an expunction or non-disclosure. Most attorneys who practice criminal law should be able to answer your questions.
