Legal Question in Criminal Law in Texas
Proof of Insurance
I have a failure to appear on my record since May of 2005 due to failure to provide proof of insurance. However the only two times I was ever issued a citation in Bell County was when I was in two seperate accidents and both times was given a ticket for no insurance though I did have insurance at the time just not a accurate insurance card. Both times I went to the court on my appearance date and removed the insurance citation. I recently discovered on March 9th 2007 when I attempted to renew my license that I had this on my record from 2 years ago. I spoke to a Court clerk and she informed me that since it has been so long there is no way I can provide proof of insurance to eliminate the $330 fine so I can renew my license. I think this is outrageous that it was not taken care of when I went into the court. She did tell me I came in to file a 30 day extension and then never came in after that. The fine is beyond me financially and I need to know what are my options in dealing with this. I rather not pay a lawyer that costs the same as this fine just to get it eliminated. So currently I am at a loss of what I am to do, to deal with this.

Re: Proof of Insurance
Since you don't want to hire a lawyer, your options are limited.
If you pay the fine, and have a conviction for no insurance, you will be paying the state a fee, and higher insurance rates for the next two years at least.
You might take your proof of insurance at that time, together with your proof of your appearance in court on that date two years ago, in person to the court, and ask that the case be dismissed.
