Legal Question in Criminal Law in Texas
prostition charge 8 years ago
I need to have the ONLY thing on my record expunged. It is a prostition charge back in 1998.It was my very first offense, I paid fines and was put on 6 month's probation. I desperately need it removed so that employer's will not find. How much does it cost? How long before it comes off my record?

In order for a charge to be expunged it needs to meet certain criteria such as it was dismissed, or a not guilty. If you plead to the charge it cannot be "expunged." If you recieved a deferred adjudication the law recently changed to allow for what is called a petition for non-disclosure. The charge remains on your record however it will only be viewed by law enforcement,i.e. your employer will not be able to see it if a criminal search is done. I cannot tell you what all lawyers will charge although the range is from $500.00 upwards to $2,000.00 PLUS filing fees which are in the neighborhood of $200.00. This process will take from 2 to 3 months. It is best to call an attorney and set up a consultation to discuss the matter in person.

This first question that must be asked is what form of probation were you on?
If you were on deffered probation it can be expunged.
If you were on regular probation it could be more complicated.
Respond back with more information for me.
