Legal Question in Criminal Law in Texas

Psychiatric evaluation in Dallas County

My mother is awaiting her court date this coming Thursday at Lew Sterret in Dallas County. She has been there for around 60 days. Her lawyer had told me in the beginning that the judge required a psychiatric evaluation for her, but she has yet to receive one. What exactly is a psychiatric evaluation and should I be concerned that it has not yet happened and court is in two days now?

Hello there,

The psychiatric evaluation was ordered because there must be some signs that your mother may not be competent or is suffering from a psychiatric disorder.

The court want to know if she has any kind of disorder because she cannot intelligently enter into a plea until the court is satisfied that she understands the consequences of her actions.

Sincerely,

Is the attorney representing your mother retained by you, or appointed by the court? If appointed you may want to consider retaining an attorney on her behalf. Court dates are frequently reset, however, since she is a jail case, she should be getting priority for services.
