Legal Question in Criminal Law in Texas
Public-Intoxication
I was having some drinks with a friend at my apartment pool after hours when the police showed up and said there had been a complaint. The apartment is a gated community and I was at ''home''. I was handcuffed and taken to the city jail where I spent about 6 hours. Upon release I was given a citation for public intoxication that read personal bond. I was never read any rights or told that I was arreseted. So my question is was I ARRESTED or just DETAINED for the charge? What are my options and where do I stand? Did the police have reason to be there and do what they did? Thanks I appreciate your help.
