Legal Question in Criminal Law in Texas

Purchase of Temp Liquor Permit by School

I am the business manager at a Texas parochial non-profit school. In a few weeks the school will have its regular fall festival. It is customary and traditional to have beer. However, the school cannot purchase the temporary liquor permit in the school’s name. What the festival organizers plan to do is have the church or some other organization purchase the permit and then the school reimburses the organization that purchased the permit. In my opinion, this is a deliberate act to circumvent the statute or law and while it may not specifically violate the law, it breaks the spirit of the law.

The school is still paying for the permit. Could the school face possible charges in handling the purchase of the permit this way?

I am responding to your question, only because several days have elapsed without a response. This is NOT my area of expertise, and I strongly recommend that you consult an attorney familiar with TABC regulations. Having practiced law 26 years this has trouble passing the smell test. The smell test is not infallible, and really think you need an attorney consultation BEFORE the fact.
