Question about defendant advantages

I am a school teacher in Texas. Two years ago I was involved in an incident with a student where I became angry with him and threw a pencil and hit the young man in the shoulder. As soon as it happened I apologized to him. He got his mother involved and told her that I injured his eye. He never flinched, said ouch, or showed any signs of an injury. The mother filed assault charges on me and I was asked to resign in my district. I was allowed to find another job which I did and I have a perfect record in this district and a great repore with my kids. I was arrested after two years and they had bumped up the charge to Injury to a Child. I am on leave while my attorney handles the situation. My questions are what advantgaes do I have? Will I go to jail? Will a District Attorney look at this and say thats too long ago? I am confused. My lawyer seems to think that I will not go to jail and I have to trust him. Please help me have some peace of mind. My criminal record has been clean so far.

Although this can be a serious matter, it is probably blown out of proportion because there was no serious bodily injury. It is unlikely you'll receive prison time. The older the case the harder it is to prosecute. The victim may be unwilling to testify at this point. A lot depends upon the prosecutor, the victim and the experience and skill of your attorney.
