Legal Question in Criminal Law in Texas
Am I ready for Expunction!
In 2006, there was a complained filed against me. After about a month, I was arrested and they gave me a date to be present in the court. On the day I went to court, they dismissed the case for further investigation. It has been exactly 2 years now from the date of offense, not the dismissal of the case. They never called me for another court date as the case was dismissed. Can I file for expunction now since it has been 2 years from the date of offense and the statute of limitation is expired or it is still tolling because of the first 2 month in which I was arrested and then finally getting discharged from the case.

If the case has been dismissed and has not been refiled, then yes you are eligible for an expunction assuming that this was a misdemeanor case.
