Legal Question in Criminal Law in Texas

hi recently my boyfriend got pulled over and had no insurance and his license was suspended and he had a warrant. He was sent to jail and was there from 8am to 10:30pm. he didn't bond out they let him go. He said they told him he was clear. He also stated he appeared before a judge to whom he pleaded guilty to. My question is in th state of Texas, Houston to be exact. Has his license been reinstated? can he drive? does this go on his record?

In Texas there is a process to getting a suspended driver's license reinstated. The process is different depending on the reason for the suspension. The driver's license holder is supposed to get a letter from the Texas Department of Public Safety which outlines the reason for the suspension and the driver's license holders rights and steps that need to be taken. Many times these letters go to the wrong address because people do not update their address on the license as required. However, the notice is presumed to be good notice if sent to the last known address.

The best thing to do is to contact the Texas Department of Public Safety in Austin and inquire about how to get the driver's license reinstated. The driver's license holder will need to call. Information will not be given to another person.

Also, if reinstatement process for that individual will require legal advice, the Texas Department of Public Safety will not give out legal advice. They will only give procedural information.

Sometimes the only thing that is needed to get a license reinstated is to let the suspension period expire, pay fees owed if any, and pay the reinstatement fee. Sometimes the suspension period is too long to wait out and an occupational license needs to be applied for.

A person with a suspended driver's license is not allowed to drive. That is a criminal offense and a person could go to jail for driving while license suspended. A driver's license suspension does go on the driving record and criminal history in certain circumstances.
