Legal Question in Criminal Law in Texas

I was recently charged with a DWI. It doesnt look good. Is there any lesser charge than a DWI in Texas? I feel like I will never get a job, EVER!!! I made a mistake. The DA is forcing me into a plea I am not comfortable with. I would fight it, but trials are sooo expensive. I need help.

What does your lawyer say? Depending on the county your case is in, there may be some options for different charges, like a reckless driving or an obstruction of a highway. . If you are in Harris County, your options will likely be 30 days in jail, a year of probation, or enter the DIVERT program.

Prior to entering into any agreement, however, your lawyer should evaluate the case and determine if the State will have any problems.

If you are in Bexar County, and this is your first DWI, you MAY qualify for the DA's "take responsibility program" which will permit you to plead to "obstructing a public roadway" which is also a class B misdemeanor.

Other counties may permit you to make similar plea bargains. Ask your attorney.

No county in Texas will permit you deferred adjudication. By law, deferred is not available to DWI defendants.

Regarding the job situation, unless you drive for a living DWI is not that bad. Even judges have been charged with DWI. Regarding the license suspension issue, ask your lawyer about getting an occupational drivers license.
