1 Answer from Attorneys
The maximum fine for this offense is $2000 and 180 days in jail. This is the absolute worst that could happen.
What actually happens depends upon the facts and what county you are in.
You will not be tried or sentenced at the first hearing.
The purpose of this hearing is for the court to find out whether you have an attorney and to appoint one for you if you are indigent or prove you additional time to hire one if you are not.
The judge will also want to make sure you have been told the maximum range of punishment in your case.
These are the most important things you can do.
1. Show up in court on time. It helps to call ahead to get the location of the courtroom, the courthouse, and a good place to park.
2. When your name is called, be sure to stand up and say present in a voice loud enough so the judge can hear you.
3. If you have or are assigned a lawyer at this point, listen and ask questions.
4. Do not leave until someone tells you that you can leave. If your case is not resolved that day, you will need to know what day to come back. This is usually called a reset and you will have to sign a form showing the date you need to come back
5. If your case is resolved that day, such as with a plea bargain, you will see the judge, who will tell you what to do or will direct you to someone who will. If you have a lawyer, ask your lawyer what to do.
