Legal Question in Criminal Law in Texas
I recently received a deferred adjudication on an Assault-Family Violence charge and was wondering if it is possible to get this expunged off my record since I'm not eligible for motion for non-disclosure because of the offense. I'm in Austin, Texas. Someone please help! I can't sleep at nights because of my record now. Thank You!

Unfortunately, no. You can only expunge a case where you got a dismissal or a not guilty verdict. The only option on a deferred adjudication is a non-disclosure, which, as you know, is not available for an Assault-Family violence deferred.

No. You cannot. This should have been explained to you prior to taking a deal.
