Based on what you have written, there are a few different options that are potentially available. With the theft being under $50, the case is a Class C Misdemeanor and therefore the maximum punishment is a fine - no jail. The odds of the case being dismissed is determiative upon who the alleged victim is and which court is hearing your case. Which court is your case in? And who is alleged to be the victim in this theft case? You should consider speaking with a local law firm to assist you in protecting your rights. If my local law firm can assist you with this legal issue or any other legal matter, please contact us at [email protected] or at our office number below to arrange for an initial consultation. The response given is based upon the limited facts provided by the person asking the question. To the extent additional or different facts exist, the response might possibly change.
You want to be able to get this off your record at some point. If they will not dismiss the case, ask for deferred adjudication. After two years from the date you successfully finish the deferred, you can file a petition for nondisclosure. This erase the offense from most but not all records.
