Re: get my record expunged

What you are seeking is an order for non-disclosure, rather than a expungement of your records. If you have successfully completed a term of deferred adjudication, then you might be eligible for the non-disclosure. Non-disclosure seals your criminal records and prohibits the Texas Department of Public Safety from disseminating your records into the public domain. Depending upon what offense you were on deferred adjudication for, there may, or may not, be a waiting period before you can apply.

Re: get my record expunged

Based on what you have written, it appears that you may not qualify for an expunction. Expunctoins are governed by Chapter 55 of the TX Code of Criminal Procedure. Generally, to qualify for an expunction, the alleged defendant case must have had no probable cause. If you were placed on probation, the odds are that probable cause was found in your case. You should seek requesting the Court to issue an order of non-disclosure in your case. This will shield your criminal record information from beign released to others. If my criminal defense law firm can assist you with this legal issue or any other legal matter, please contact my legal assistant Jennifer ([email protected]) to arrange for an initial consultation.
